Thank you for your interest in Online Divorce. There are a number of matters that we must draw to your attention and that you will need to deal with before the Divorce Proceedings can start. These are as follows:-

Procedure

1. If the divorce is undefended then there will be no hearings to attend. If there is a dispute over children or financial matters the Court will that deal with the divorce. You would have to attend any hearing that took place on these matters.

2. We will ask you to complete forms that will assist us in the preparation of your case. Once you have completed these forms and paid our fee we will process your divorce case for you.

3. The full divorce procedure is set out in greater detail in our Divorce Leaflet.

4. If the divorce is defended or there are difficulties in dealing with the divorce that result in more work to be done, we reserve the right to review our charges with you and agree a different basis for our charges.

5. As part of the divorce you may be able to claim your costs from your spouse. The possibility of your spouse contributing towards your costs should be considered before the divorce is started. If you do not tell us you want to include a claim for costs this will be omitted.

6. Our charges in dealing with the divorce do not cover any advice or work that you wish regarding your children or financial matters. If you wish further advice on those aspects then we will agree our charges with you in advance before any work is done.

7. We draw your attention to our Client Care Agreement setting out our terms of business which we must ask you to sign and return to us before we do any work. We will also need a photocopy of your driver’s license and another form of verifiable identification. One of these identifications must have your current address on it, for example a utility or council tax bill. Please have the photocopy of your identification certified by a person from a professional body i.e. solicitor, doctor, local bank, building society, estate agent, mortgage advisor etc.

8. You will be able to access all of the information on the interactive web page. Please complete the Divorce Online Questionnaire and email it to michelle.ellis@rosscoates.co.uk or alternatively post it with the documents referred to below. If you have children, the Statement of Arrangements as to Children. We also need your original marriage certificate to file with the court. For the Statement of Arrangements, the Court requires your original signature on the document. You will therefore need to post the marriage certificate and statement, client care agreement, copy ID and cheque for the court fees if not included in the credit card payment to us.

9. Once you have dealt with the above we will prepare all the necessary documents to start the Divorce Proceedings and send the petition to you to approve.

10. All the necessary work in your case will be done by the members of the Family Team as set out in the Client Care Agreement. The head of that team is Mrs. Michelle Ellis. 11. The use of email and the internet will speed up the process by which a divorce takes place but this is dependent upon you providing us with the information and documents where necessary as quickly as possible. We are unable to take any further action until you have dealt with the points and matters set out in this letter.

12. This service is designed for situations where there is no dispute over the divorce between spouses and the procedure will then be straightforward. The Court could still refuse to allow the divorce or you spouse could refuse to co-operate. In the event that we are no longer able to deal with your divorce for a fixed fee we would discuss this with you. Your spouse has the right to see a solicitor and take independent advice as we will only be acting for you.

Financial Matters

13. This service deals with the actual divorce and our instructions are initially limited to this. It is however very important that financial matters between you and your spouse are dealt with. In many cases the Decree Absolute ending your divorce should be delayed until all financial matters are concluded. Just because a divorce is concluded does not proven a financal claim being made at anytime there after.

14. Even if financial matters are agreed it is still advisable to get this recorded in a Court Order by Consent within the Divorce Proceedings to prevent further claims. For more information on finances, please read our Financial Leaflet.

15. We can advise you on financial matters or assist you to seek a Court Order recording an agreed financial settlement. We charge on a hourly rate in this regard. It is vital that you deal with the financial matters before the divorce is concluded.
