The Moroccan Property Department will advise you on any concerns you may have regarding your proposed purchase, such as:
Ownership structures options: is it better for you to purchase alone or as joint-owners, and if so in what shares, or as a company? Issues such as taxation and inheritance should be taken into account regarding your particular situation and plans for the property (i.e. do you intend to sell before completion or do you intend to own the property for several years?).
Mortgages: do you require a mortgage to finance your purchase? Will a Moroccan bank accept to offer you a suitable mortgage or will you need to consider raising finances by re-mortgaging another property? If you are planning to apply for a Moroccan mortgage, what is the application process and what formalities will be undertaken regarding the release of funds?
Ownership: who actually owns the land on which the development will be situated? Have you been provided with proof of this? If the vendors are not the true owners, who are?
Planning permission: has planning permission been granted regarding the development and if so what stage have they reached?
Architect: has an architect been instructed? Have you seen a copy of the agreement made between the architect and the vendors? What guarantees do they provide regarding the building works?
RPS 2000 regulations: will the property be built in accordance with the RPS 2000 regulations regarding the property being earthquake resistant?
Building works: have the building works commenced and if so what pertinent stages have been reached?
Financial bank guarantee: do the vendors provide a bank guarantee and if so, are they complying with the bank’s conditions?
Rental Agreements: are the vendors offering a rental agreement? If so, what are the terms and conditions? Will you have any entitlement to use the apartment yourself and if so, when may you do so?
Completion date: What is the completion date? Has the date been stated in the reservation contract? What are your options if the vendors do not fulfil their obligations in this respect? Is there a penalty clause in case of late delivery by the vendors?
Completed apartment: is the completed apartment as you had expected and if not, what legal action can be taken
Co-Ownership: you are purchasing an apartment, you will therefore need to accept the Règlement de Copropriété ; have you been provided with copy of those and if so do you understand them?
